DA Eyster: There’s no sanctuary in Mendocino County for law-breaking immigrants

This statement from Mendocino County District Attorney David Eyster was posted on the DA’s official Facebook page. MendoFever is sharing it to give readers insight into the local DA’s prosecutorial philosophies.

In response to recent local inquiries, the Department of Homeland Security (DHS) did previously release — but then quickly withdrew — a list of purported “sanctuary jurisdictions” which listed 48 of California’s 58 counties, a listing that included Mendocino County as one of the sanctuaries.

The now-withdrawn list was created based on a presidential executive order requiring Attorney General Bondi to identify jurisdictions that are perceived to be obstructing federal immigration enforcement.

So, yes, Mendocino County was on the flawed list as a jurisdiction believed by DHS and Attorney General Bondi to be a “sanctuary jurisdiction.”

The bigger question is why Mendocino County and only 47 other California counties were listed versus all 58 California counties is not clear at all.

The answer is not clear to that bigger question because all 58 California counties are subject to the “California Values Act ,” a law enacted by the California Legislature in 2017, effective January 2018. SB 54 limits California law enforcement agencies, including school police and security departments, from using money or personnel “to investigate, interrogate, detain, detect or arrest individuals” for immigration enforcement purposes.

To that end, SB 54 bars state and local law enforcement from cooperating with immigration holds that in the past would be placed by the feds against those being held in local jails on local criminal charges and convictions, and further restricts local law enforcement’s ability to respond to immigration notification and transfer requests (Govt Code §§7282, 7282.5).

While many in local law enforcement do not agree with the “means to the end” being used elsewhere in the country that are being reported nightly on the evening news to “enforce” federal immigration laws, one thing is crystal clear. Mendocino County is not nor has it ever been a place providing sanctuary to criminals who also happen to be in the country illegally.

  1. Bull crap. Mendocino county sure as hell has been providing sanctuary… if not all the vineyards would have been raided regularly in this county. Also the ag worker housing in Ukiah would never have been allowed to be built.
I could go on & on & on.
Hell there is a guy in the Willits valley who murdered a man in Mexico with a machete & Mexico asked for him to be extradited but county law officials wouldn’t do it so he walks free, in our community, as I type this. He even admits that he did it.

    • What bothers you more? The fresh fruit stands bothering nobody, OR the meth/fent users blocking sidewalks & screaming & hollering on almost every street in town???? I once had a guy chase me down Orchard Ave. while high out of his mind with a large pole in his hands! It was like a movie….. The Walking Dead to be exact!

    • I thank all the fruta vendors for offering a fresh fruit snack for my family instead of soda and fries. Street food for the masses!! Street food for the people! Don’t be scared of fruit! Be scared of McDonald’s and Starbucks selling you poison in a cup while using immigrant labor behind the scenes regardless! Eat fruit! Long live fruit stands! Hurray for communal marketplace!

  4. Article VI, Clause 2, of the U.S. Constitution, also known as the Supremacy Clause, establishes that the Constitution, federal laws made in accordance with it, and treaties made under the authority of the United States are the supreme law of the land. This means that these federal laws and treaties take precedence over any conflicting state laws or state constitutions. Mendocino County is no exception, despite what the loony left wants everyone to believe. PS. The majority of the hard-working people who work in agriculture in this county, whose ancestors came from Latin America, were born in the U.S.A.

    • “Corruption” is a generality. Pull some names out of your magic rabbit hat, specifically cite which laws were allegedly broken.

      • Bribery, pay to play, falsification of evidence, perjury, brown act violations, personal use of non secure emails. All admittedly committed and swept under the rug by our own fabulous Diamond Dave. It’s known, been known and nothing is done about the dysfuntion.

        • And the rumor is he has failed to report unidentified aerial phenomena. If you actually believe what you have stated, bring all of this to the attention of the State Attorney General’s office. And, not to forget, Mendocino’s own, Jim Jones, pulled cancer out stomachs. Mendocino County has morphed into an ongoing kangaroo court. Accusations are truth and fantasy rules.

          • It has been numerous times. The refusal refused. Look back at c plethora of examples of misconduct and discords. Yada, Yada, nada, nada. Somehow it is glossed over. Manynprevious defendants demoralized and demeaned as part of the process, left as collateral damage in the name of Mendocino County’s twisted definition and interpretation of LAW
